The New Zealand Law Society’s Property Law Section has advised its members that a decision made in the Auckland High Court on 1 April could be highly relevant to some situations now existing in Christchurch as a result of the earthquake. The reserved decision of Priestley J in Russell & others v Robinson & others HC Auckland CIV-2010-404-5992, 1 April 2011 concerns a situation in which an Auckland commercial property became untenantable by the lessee.
