Minister requests Law Commission family violence investigations

20 July 2015

Justice Minister Amy Adams has requested the Law Commission to commence two new references in the family violence area.

The first reference will look at victims of family violence who commit homicide. The Commission will re-consider whether the law in respect of a victim of family violence who commits homicide can be improved. It will be led by Law Commissioner Wayne Mapp.

The second reference will look at non-fatal strangulation as a separate crime. It will be led by Law Commissioner Peter Boshier. The Commission will review if a separate crime can be a tool to reduce future family violence.

The Law Commission will establish an Experts Committee to assist in completion of the references. it is required to report to the Minister of Justice by 31 March 2016 on both references.
