Harmful Digital Communications legislation fully in force from 21 November

The Harmful Digital Communications Act Commencement Order (No 2) 2016 provides that sections 8 to 21 and 26 to 28 of the Harmful Digital Communications Act 2015 will come into force on 21 November 2016.

This means that the Act will be fully in force from that date.

In May 2016 Justice Minister Amy Adams announced that Netsafe had been appointed the Approved Agency under section 7 of the Act.

The Approved Agency's role includes advising on steps people can take to resolve a problem, investigating and attempting to resolve complaints where harm has been caused, and providing education and advice about online safety and conduct.

The Harmful Digital Communications Rules 2016 will also come into force on 21 November 2016. The objective of the rules is to enable proceedings to be brought and dealt with under the Harmful Digital Communications Act 2015 "justly, speedily, and inexpensively".
