New Court of Appeal Practice Note for bail

Court of Appeal President Stephen Kós has issued a Practice Note for bail applications and appeals.

The note outlines the manner in which bail applications brought under section 54 of the Bail Act 2000 will be heard in the Court of Appeal.

The applications will be heard in Court (including by AVL where permitted, but not by telephone) and not on the papers, by a single Judge (or three where section 333(3) of the Criminal Procedure 2011 applies) and listed in the online daily fixtures list and Court foyer list.

Bail appeals brought under section 42 of the Bail Act 2000 will be heard by the Court of Appeal in Court (unless the criteria in section 329(2) or (3) of the Criminal Procedure Act 2011 apply, when the appeal will be dealt with on the papers), by three Judges in either case, and listed in the online daily fixtures list and Court foyer list.
