Commission gets class action and litigation funding go-ahead

The Law Commission says the Minister responsible for the Law Commission, Andrew Little, has confirmed that it should progress the Class Actions and Litigation Funding project after completing the second review of the Evidence Act 2006 in February 2019.

In its latest Te Aka Kōrero newsletter, the Commission says the Class Actions and Litigation Funding review was put on hold in 2018.

This was due to the reallocation of staff to complete the priority request from the Minister regarding abortion law reform.

The Commission says the review is now in the early stages of being reactivated.

An article on Litigation funding and class actions in New Zealand in the June 2019 issue of the Law Society's LawTalk magazine says the New Zealand Law Society strongly supports revival of the review.

Mr Little was also quoted as saying he was keen for the work to resume.

"I know that litigation funding is becoming a more regular feature of our legal landscape," he said. "It's important because for some people the only way that they can conduct litigation and get access to justice is through third party litigation funding."
