Rodney James Day has been sentenced in the Christchurch District Court  following a guilty plea in July 2019 to 15 charges, including four counts of forgery under the Crimes Act 1961.

MBIE says Mr Day is the first unlicensed builder to be sentenced under the Crimes Act 1961 since the introduction of the Licensed Building Practitioners (LBP) scheme. The LBP scheme was introduced to ensure consumers can make informed decisions when it comes to hiring builders to undertake restricted building work.

MBIE sayst Mr Day used the name and details of a Licensed Building Practitioner (LBP) without their knowledge to complete the producer statements for the properties.

“Charges under the Crimes Act are not brought about lightly, and MBIE will not hesitate to investigate and prosecute people who commit these offences,” says MBIE’s Occupational Licensing Operations Manager Duncan Connor.

MBIE says the District Court Judge noted that the offending was clearly pre-meditated, the level of deception was high, and the defendant had deceived a large number of people.

Mr Day was sentenced to seven months home detention and 150 hours community work.
