A revised Court of Trial Protocol came into force on 1 February 2016, replacing the previous protocol published on 30 January 2015.

The protocol, established by the Chief High Court Judge and the Chief District Court Judge, identifies cases and classes of cases which must always be considered for transfer to the High Court in accordance with section 66 of the Criminal Procedure Act 2011.

It is the obligation of the prosecution to identify cases falling within the protocol.

The protocol has been developed following consultation between the Chief High Court Judge and the Chief District Court Judge.
