Regulations notified: 16 to 22 December 2011

The following regulations were notified in the New Zealand Gazette published on 22 December 2011:

Securities Act (Translated Advertisements) Exemption Notice 2011 (SR 2011/428) 
Made pursuant to section 70B of the Securities Act 1978 on 19 December 2011. Came into force on 20 December 2011 and expires on 30 November 2016. Applies where fewer than two directors of an issuer are fluent in the language in which an advertisement is distributed to the public. Allows the directors or their authorised agents to complete the advertisement certificate required by regulation 30(2) of the Securities Regulations 2009 if the directors or agents have read, seen, or listened to a translation of the advertisement.

Securities Act (Multiple Participants Superannuation Schemes) Exemption Notice 2011 (SR 2011/429) 
Made pursuant to section 70B of the Securities Act 1978 on 19 December 2011. Came into force on 20 December 2011 and expires on 30 November 2016. Replaces the Securities Act (Multiple Participants Superannuation Schemes) Exemption Notice 1998 on substantially the same terms, updating references to the Securities Regulations 2009 from the Securities Regulations 1983, with some changes to clarify terms and conditions of the notice. Exempts superannuation trustees, employers and certain other participants in multiple participation superannuation schemes from certain provisions of the Securities Act 1978 and the Securities Regulations 2009.

Securities Act (Directors’ Certificates – Collective Investment Schemes) Exemption Notice 2011 (SR 2011/430)
Made pursuant to section 70B of the Securities Act 1978 on 19 December 2011. Came into force on 20 December 2011. Clauses 6 and 7 expire on 30 September 2012 and the remainder expires on 31 December 2013. Exempts, subject to conditions, the issuers of certain collective investment schemes from section 37A(1A)(c)(i) of the Securities Act 1978. Relates to the certificate that may be registered which allows the date of allotment of securities to be more than 9 months after the date of the statement of financial position referred to in the prospectus.

Climate Change (Unit Register) Amendment Regulations 2011 (SR 2011/431) 
Made pursuant to sections 30G and 30H(4) of the Climate Change Response Act 2002 on 19 December 2011. Comes into force on 23 December 2011. Amends the Climate Change (Unit Register) Regulations 2008. Inserts a new regulation 8A which applies to industrial gas certified emission reduction units generated from the destruction of hydrofluorocargon-23 (HFC-23) or the destruction of nitrous oxide resulting from the production of adipic acid.

Deposit Takers (Funding Conduits) Exemption Amendment Notice (No 3) 2011 (SR 2011/432)
Made pursuant to section 157G of the Reserve Bank of New Zealand Act 1989. Comes into force on 23 December 2011. Amends the Deposit Takers (Funding Conduits) Exemption Notice 2010 by extending a temporary unconditional exemption that currently applies to GPG Finance plc and then removing GPG Finance plc from the cover of the exemptions altogether.

Judicial Salaries and Allowances Determination 2011 (SR 2011/433) 
Made pursuant to sections 12B(1) and 19 of the Remuneration Authority Act 1977 and section 9A(1)(a) and (b) of the Judiciature Act 1908, section 6(1)(a) and (b) of the District Courts Act 1947, section 206(1)(a) and (b) of the Employment Relations Act 2000, section 13(1)(a) and (b) of the Te Ture Whenua Maori Act 1993, section 26F(1)(a) and (b) of the Judicature Act 1908 and section 110(1)(b) of the Coroners Act 2006. Came into force on 1 October 2011 (retrospective) and expires on 30 September 2012. Sets the salaries and principal allowances for the Judges of the Supreme Court, the Court of Appeal, the High Court and District Court benches (including the salary and allowance of a District Court Judge who currently holds the judicial office of chief coroner), the Employment Court, and the Maori Land Court.
