The following regulations were notified in the New Zealand Gazette published on 17 November 2011:
Bail Amendment Act 2011 Commencement Order 2011 (SR 2011/411)
Made 14 November 2011. Brings sections 4 and 5 and 7 to 14 of the Bail Amendment Act 2011 into force on 5 March 2012. These amend the powers of the court to exercise its discretion, and impose conditions, when considering bail pending sentencing, substitute a new section 19 of the Bail Act 2000, which relates to the publication of matters relating to a bail hearing,amend the provisions relating to the execution of a warrant to arrest the defendant to provide that the requirement to produce the warrant for inspection may be satisfied by producing a copy of it, and make transitional provisions in relation to the coming into force of the above provisions.
Crimes Amendment Act (No 4) 2011 Commencement Order 2011 (SR 2011/412)
Made 14 November 2011. Brings sections 4(1) and 5 of the Crimes Amendment Act (No 4) 2011 into force on 5 March 2012. These provisions allow the obligation in section 316 of the Crimes Act 1961 to produce a process or warrant for inspection to be satisfied by producing a copy of the process or warrant and also make a transitional provision in relation to the use of a copy of a process or warrant.
Criminal Procedure Act Commencement Order 2011 (SR 2011/413)
Made on 14 November 2011. Brings sections 5, 7, 8, 60 to 65, 115(2), 116, 245, 252, 386 to 395, subpart 3 of Part 5, and 407 to 409 of the Criminal Procedure Act 2011 into force on 5 March 2012. These relate to preliminary matters, sentence indications, public access and restrictions on reporting, powers relating to making rules and regulations and a transitional provision relating to appeals.
Juries Amendment Act 2011 Commencement Order 2011 (SR 2011/414)
Made on 14 November 2011. Brings sections 4 to 6 of the Juries Amendment Act 2011 into force on 5 March 2012. These provide that a proceeding may continue with fewer than 10 jurors in certain circumstances.
Summary Proceedings Amendment Act (No 2) 2011 Commencement Order 2011 (SR 2011/415)
Made on 14 November 2011. Brings sections 4 to 6 of the Summary Proceedings Amendment Act (No 2) 2011 into force on 5 March 2012. Thee amend the powers of a Registrar of a District Court to withdraw a warrant to arrest a defendant or witness, make transitional provision in relation to the amendment of the powers of the Registrar to withdraw a warrant and provide for the expiry of section 4 of the Act.
Victims’ Rights Amendment Act 2011 Commencement Order 2011 (SR 2011/416)
Made on 14 November 2011. Brings sections 4 to 7 of the Victims’ Rights Amendment Act 2011 into force on 5 March 2012. These provide that victim impact statements may be used by the court when giving sentence indications and also make a transitional provision in relation to the use of victim impact statements prepared before these provisions came into force.
Education (2012 School Staffing) Amendment Order 2012 (SR 2011/417)
Made on 14 November 2011 under the Education Act 1989, comes into force on 2 December 2011. Amends the Education (2012) School Staffing Order 2012 by inserting a new clause to prescribe a new limitation which prevents a school's board (being a board that employs 1 or more resource teacher managers: learning and behaviour) from employing specified resource teachers to whom leadership payments have been allocated if the total of those payments would exceed a number, calculated in a prescribed way, of those payments for the school.
Building (Forms) Amendment Regulations 2011 (SR 2011/418)
Made on 14 November 2011 under section 402(1)(k) of the Building Act 2004, comes into force on 1 March 2012. Amend the Building (Forms) Regulations 2004 to make provision for the introduction of restricted building work.
Health Practitioners (Quality Assurance Activity – Ormiston Hospital) Notice 2011 (SR 2011/419)
Made under section 54 of the Health Practitioners Competence Assurance Act 2003. Comes into force on 18 November 2011. Declares the quality assurance activity called the Ormiston Hospital Quality Assurance Activity to be a protected quality assurance activity.
Fisheries (Remaining Cost Recovery Settlement Balance) Notice 2011 (SR 2011/420)
Made under section 265A(5) of the Fisheries Act 1996. Comes into force on 18 November 2011. Sets out the remaining balance of the settlement sum applying to Northland scallops (SCA1).
