Regulations notified: 23 to 29 March 2012

The following regulations were notified in the New Zealand Gazette published on 29 March 2012:

Accident Compensation (Motor Vehicle Account Levies) Regulations 2012 (SR 2012/40) 
Made pursuant to sections 213(7), 329, and 333 of the Accident Compensation Act 2001. In force 1 May 2012. Prescribe the annual rates of the motor vehicle levy, Motorcycle Safety levy, and fuel levy and state when payable.

Misuse of Drugs (Classification of Tapentadol) Order Commencement Order 2012 (SR 2012/41)
Made pursuant to section 4A(1) of the Misuse of Drugs Act 1975 and a resolution of the House of Representatives made on 1 March 2012 in accordance with section 4A(3) of that Act. In force 1 May 2012. Brings the Misuse of Drugs (Classification of Tapentadol) Order 2011 into force on 1 May 2012. That order adds tapentadol (3-[(1R,2R)-3-(dimethylamino)-1-ethyl-2-methylpropyl]phenol hydrochloride), which is to be classified as a class B3 controlled drug, to Part 3 of Schedule 2 of the Misuse of Drugs Act 1975

Canterbury Earthquake (Social Security Act) Order (No 2) 2010 Amendment Order 2012 (SR 2012/42)
Made pursuant to section 71 of the Canterbury Earthquake Recovery Act 2011. In force 30 March 2012 and expires 31 March 2014. Defers the expiry of the Canterbury Earthquake (Social Security Act) Order (No 2) 2010 for 2 years.

Social Security (Income and Cash Assets Exemptions) Amendment Regulations (No 3) 2012 (SR 2012/43) 
Made pursuant to sections 132 and 132AA of the Social Security Act 1964. In force 30 March 2012. Amend the Social Security (Income and Cash Assets Exemptions) Regulations 2011. The amendments extend from 12 months to 24 months the period in which certain payments (and related interest derived from them) made in relation to the Canterbury earthquakes are to be exempt from being treated as cash assets, but only if the chief executive is satisfied that the person to whom a payment is to be or has been made intends to use or has used the payment to repair or rebuild any existing residential premises, or to purchase any replacement residential premises; and clarify that if certain payments are paid in instalments, or 1 or more payments are made, the date that the payments are made is the date on which the final instalment is paid or the last payment is made.

Social Security (Long-term Residential Care) Amendment Regulations (No 3) 2012 (SR 2012/44)
Made pursuant to section 155 of the Social Security Act 1964. In force 30 March 2012. Amend the Social Security (Long-term Residential Care) Regulations 2005.

Social Security (Temporary Additional Support) Amendment Regulations (No 3) 2012 (SR 2012/45)
Made pursuant to section 132AB of the Social Security Act 1964. In force 30 March 2012. Amend the Social Security (Temporary Additional Support) Regulations 2005.

Fisheries (Auckland and Kermadec Areas Amateur Fishing) Amendment Regulations 2012 (SR 2012/46)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend the Fisheries (Auckland and Kermadec Areas Amateur Fishing) Regulations 1986 to provide that 5 is the maximum daily number for bluenose in relation to the Auckland fishery management area.

Fisheries (Central Area Amateur Fishing) Amendment Regulations 2012 (SR 2012/47)
In force pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend the Fisheries (Central Area Amateur Fishing) Regulations 1986 to correct the description of Central Fishery Management Area and provide that 10 is the maximum daily number of blue cod in relation to the Fishery management area 8—Central (Egmont); and 5 is the maximum daily number of bluenose in relation to the Central Fishery Management Area.

Fisheries (Challenger Area Amateur Fishing) Amendment Regulations 2012 (SR 2012/48)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend the Fisheries (Challenger Area Amateur Fishing) Regulations 1986 to provide that 5 is the maximum daily number of bluenose in relation to the Challenger fishery management area.

Fisheries (South-East Area Amateur Fishing) Amendment Regulations 2012 (SR 2012/49)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend the Fisheries (South-East Area Amateur Fishing) Regulations 1986 to provide that 5 is the maximum daily number of bluenose in relation to the South-East fishery management area.

Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2012 (SR 2012/50)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend regulation 3E of the Fisheries (South-East Area Commercial Fishing) Regulations 1986, which relates to set net soak times. The amendments replace regulation 3E(3) to resolve ambiguities in the description of the waters (known as Banks) specified in that provision; and revoke regulation 3E(4) and (5) because they are redundant provisions.

Fisheries (Southland and Sub-Antarctic Areas Amateur Fishing) Amendment Regulations 2012 (SR 2012/51)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Amend the Fisheries (Southland and Sub-Antarctic Areas Amateur Fishing) Regulations 1991.The amendments correct the description of the internal waters of Fiordland; and provide that 20 is the maximum daily number of blue cod; and 5 is the maximum daily number of bluenose in relation to the Southland and Sub-Antarctic Fishery Management Areas.

Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations 2012 (SR 2012/52)
Made pursuant to section 297 of the Fisheries Act 1996. In force 1 May 2012. Replace items 7 and 8 of the description of the internal waters of Fiordland set out in the Schedule of the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986 to correct technical errors in the current descriptions.

Fisheries (Schedule 6) Order 2012 (SR 2012/53)
Made pursuant to section 72(7) of the Fisheries Act 1996. In force 1 May 2012. Inserts rig into Schedule 6 of the Fisheries Act 1996 as a stock that may be returned to the waters from which it was taken if certain requirements are met.

State Sector (Ministry for Primary Industries) Order 2012 (SR 2012/54)
Made pursuant to sections 30A and 30K of the State Sector Act 1988. In force 30 April 2012. Implements name change of Ministry of Agriculture and Forestry to Ministry for Primary Industries.

State Sector (Application of Certain Provisions to Transfer of Functions from Ministry of Fisheries to Ministry of Agriculture and Forestry) Amendment Order 2012 (SR 2012/55)
Made pursuant to section 30K of the State Sector Act 1988. In force 30 April 2012. Extends the transitional period during which sections 30H and 30I of the State Sector Act 1988 apply to things coming into force, entered into, or created after the transfer of functions from the Ministry of Fisheries to the Ministry of Agriculture and Forestry, by 12 months until 30 June 2013.

Ombudsmen Act (Schedule 1—Ministry for Primary Industries) Order 2012 (SR 2012/56)
Made pursuant to section 32(1) of the Ombudsmen Act 1975. In force 30 April 2012. Removes the name of the Ministry of Agriculture and Forestry from Part 1 of Schedule 1 of the Ombudsmen Act 1975 and inserts the name of the Ministry for Primary Industries, which is the new name for the existing Ministry of Agriculture and Forestry. The effect of the order is that, on and after 30 April 2012, both the Ombudsmen Act 1975 and the Official Information Act 1982 will apply to the Ministry for Primary Industries.

Climate Change (Eligible Industrial Activities) Amendment Regulations 2012 (SR 2012/57)
Made pursuant to section 161A(1) of the Climate Change Response Act 2002. In force 30 March 2012. Amend the Climate Change (Eligible Industrial Activities) Regulations 2010. The amendment adjusts the allocative baselines for the product produced by New Zealand Aluminium Smelters Limited.

Building (Forms) Amendment Regulations 2012 (SR 2012/58)
Made pursuant to section 402(1)(k) of the Building Act 2004. In force 30 March 2012. Insert 2 new forms in the Building (Forms) Regulations 2004 as a result of amendments to the Building Act 2004 by the Building Amendment Act 2012. Those amendments relate to restricted building work carried out by an owner-builder. The new forms are form 2B (Statutory declaration as to owner-builder status) and form 2C (Notice of owner-builder).

Taxation (Use of Money Interest Rates) Amendment Regulations 2012 (SR 2012/59)
Made pursuant to section 120H(b) of the Tax Administration Act 1994. In force 8 May 2012. Reduce from 8.89% to 8.40% the taxpayer's paying rate of interest on unpaid tax and reduce from 2.18% to 1.75% the Commissioner's paying rate on overpaid tax.

Fisheries (Rock Lobster Total Allowable Catches) Amendment Notice 2012 (SR 2012/60)
Made pursuant to section 13 of the Fisheries Act 1996. In force 31 March 2012. Amends the Fisheries (Rock Lobster Total Allowable Catches) Notice 1999. The amendments increase the total allowable catch for spiny rock lobster for the Gisborne quota management area (CRA 3) to 322.300 tonnes; and decrease the total allowable catch for spiny rock lobster for the Otago quota management area (CRA 7) to 83.900 tonnes.The changes apply on and from the fishing year commencing on 1 April 2012.

Fisheries (Rock Lobster Total Allowable Commercial Catches) Amendment Notice 2012 (SR 2012/61)
Made pursuant to section 20 of the Fisheries Act 1996. In force 31 March 2012. Amends the Fisheries (Rock Lobster Total Allowable Commercial Catches) Notice 1999. The amendments increase the total allowable commercial catch for spiny rock lobster for the Gisborne quota management area (CRA 3) to 193.300 tonnes; and decrease the total allowable commercial catch for spiny rock lobster for the Otago quota management area (CRA 7) to 63.900 tonnes. The changes apply on and from the fishing year commencing on 1 April 2012.

Futures Contracts (Financial Transmission Rights) Notice 2012 (SR 2012/62)
Made pursuant to section 37(7) of the Securities Markets Act 1988. In force 30 March 2012. declares that financial transmission rights (FTRs) are agreements to which Part 3 of the Securities Markets Act 1988 applies.
