Regulations notified: 24 to 30 August 2012

The following regulations were notified in the New Zealand Gazette published on 30 August 2012:

Takeovers Code (Trustees of Family Trusts) Exemption Notice 2012 (SR 2012/226)
Made pursuant to section 45 of the Takeovers Act 1993. In force 21 August 2012. The Takeovers Panel has granted a class exemption from rule 6(1) of the Takeovers Code for persons who are or who become trustees of a private family trust. The exemption is available for persons who increase their voting control in a code company as a result of changes to the trust's trustees. The relevant changes to trustees relate to the appointment of a new trustee or the reduction in the number of trustees of the family trust where there is no increase in voting control in a code company on behalf of the trust resulting from the changes to trustees. The exemption relates to a bona fide reorganisation of the family trust or an event outside the control of the trustees of the trust.

Land Transport (Motor Vehicle Registration and Licensing) Amendment Regulations 2012 (SR 2012/227)
Made pursuant to section 269 of the Land Transport Act 1998. In force 1 October 2012. Amend the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011.

Land Transport (Offences and Penalties) Amendment Regulations 2012 (SR 2012/228)
Made pursuant to section 167 of the Land Transport Act 1998. In force 1 October 2012. Update the Land Transport (Offences and Penalties) Regulations 1999 to take account of changes in the law dealing with motorcycle safety and alcohol interlock licences.

Search and Surveillance Act Commencement Order 2012 (SR 2012/229)
Made pursuant to section 2(2) and (4) of the Search and Surveillance Act 2012. In force 27 August 2012. Brings certain provisions of the Search and Surveillance Act 2012 into force. The Act makes provision about the powers of the Police and other enforcement officers in relation to search, seizure, and surveillance. The bulk of the provisions are commenced on 1 October 2012, with amendments to the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (and related items in the Schedule) coming into force on 30 June 2013. Section 302 of the Act, which amends the Tax Administration Act 1994, and the item in the Schedule relating to that Act, remain to be brought into force.

Animal Welfare (Forms) Amendment Regulations 2012 (SR 2012/230)
Made pursuant to section 183 of the Animal Welfare Act 1999. In force 1 October 2012. Amend the Animal Welfare (Forms) Regulations 1999 by revoking the form prescribed for search warrants. The revocation arises out of the Search and Surveillance Act 2012, which will govern applications for search warrants under the Animal Welfare Act 1999 and also dispenses with the need for search warrants to be in a prescribed form.

Children, Young Persons, and Their Families (Forms) Amendment Regulations 2012 (SR 2012/231)
Made pursuant to section 447 of the Children, Young Persons, and Their Families Act 1989. In force 1 October 2012. Adjust forms 1 to 4 of Schedule 1 of the Children, Young Persons, and Their Families (Forms) Regulations 1989 to align them with the requirements related to warrants in the recently enacted Search and Surveillance Act 2012.

Criminal Proceeds (Recovery) Amendment Regulations 2012 (SR 2012/232)
Made pursuant to section 173 of the Criminal Proceeds (Recovery) Act 2009. In force 1 October 2012. Make amendments to the Criminal Proceeds (Recovery) Regulations 2009 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke regulations 8, 9, and 10, and forms 31 to 43 in the Schedule, of the principal regulations.

Customs and Excise Amendment Regulations 2012 (SR 2012/233)
Made pursuant to section 286(1)(ff) of the Customs and Excise Act 1996. In force 1 October 2012. Amend the Customs and Excise Regulations 1996 by revoking the form prescribed for search warrants and the form prescribed for reports on the execution of emergency warrants. The revocations arise out of the Search and Surveillance Act 2012, which will govern applications for search warrants under the Customs and Excise Act 1996 and also dispenses with the need for search warrants and related forms to be in a prescribed form.

District Courts (Financial Markets Authority Form of Search Warrant) Amendment Rules 2012 (SR 2012/234)
Made pursuant to section 122(1A) of the District Courts Act 1947 and section 29 and Schedule 2 of the Financial Markets Authority Act 2011. In force 1 October 2012. Make amendments to the District Courts Rules 2009 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These rules revoke Part 9A and form 34A in Schedule 1 of the principal rules.

Extradition Amendment Regulations 2012 (SR 2012/235)
Made pursuant to section 102 of the Extradition Act 1999. In force 1 October 2012. Amend the Extradition Regulations 1999 by revoking 2 forms related to search warrants issued under the Extradition Act 1999. The revocations arise out of the Search and Surveillance Act 2012, which will govern applications for search warrants under the Extradition Act 1999 and also dispenses with the need for search warrants and related notices to be in a prescribed form.

Films, Videos, and Publications Classification Amendment Regulations 2012 (SR 2012/236)
Made pursuant to section 149 of the Films, Videos, and Publications Classification Act 1993. In force 1 October 2012. Amend the Films, Videos, and Publications Classification Regulations 1994 by revoking the form prescribed for search warrants. The revocation arises out of the Search and Surveillance Act 2012, which will govern applications for search warrants under the Films, Videos, and Publications Classification Act 1993 and also dispense with the need for search warrants to be in a prescribed form.

Gambling (Forms) Amendment Regulations 2012 (SR 2012/237)
Made pursuant to section 369 of the Gambling Act 2003. In force 1 October 2012. Amend the Gambling (Forms) Regulations 2004 by revoking the form prescribed for search warrants. The revocation arises out of the Search and Surveillance Act 2012, which will govern applications for search warrants under the Gambling Act 2003 and also dispenses with the need for search warrants to be in a prescribed form.

International Criminal Court Amendment Regulations 2012 (SR 2012/238)
Made pursuant to section 179 of the International Crimes and International Criminal Court Act 2000. In force 1 October 2012. Make amendments to the International Criminal Court Regulations 2004 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke forms ICC 13 and ICC 14 in the Schedule of the principal regulations.

International War Crimes Tribunals Amendment Regulations 2012 (SR 2012/239)
Made pursuant to section 60 of the International War Crimes Tribunals Act 1995. In force 1 October 2012. Make amendments to the International War Crimes Tribunal Regulations 1995 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke forms 5 and 6 in the Schedule of the principal regulations.

Major Events Management Amendment Regulations 2012 (SR 2012/240)
Made pursuant to section 82 of the Major Events Management Act 2007. In force 1 October 2012. Make amendments to the Major Events Management Regulations 2008 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke regulation 7, and form 3 in the Schedule, of the principal regulations.

Motor Vehicle Sales Amendment Regulations 2012 (SR 2012/241)
Made pursuant to section 144 of the Motor Vehicle Sales Act 2003. In force 1 October 2012. Make amendments to the Motor Vehicle Sales Regulations 2003 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke form 3 in Schedule 3 of the principal regulations.

Mutual Assistance in Criminal Matters Amendment Regulations 2012 (SR 2012/242)
Made pursuant to section 65 of the Mutual Assistance in Criminal Matters Act 1992. In force 1 October 2012. Make amendments to the Mutual Assistance in Criminal Matters Regulations 1993 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations amend form 4 and revoke form 5 in the Schedule of the principal regulations.

Prostitution Reform (Form of Warrants) Amendment Regulations 2012 (SR 2012/243)
Made pursuant to section 47(a) of the Prostitution Reform Act 2003. In force 1 October 2012. Make amendments to the Prostitution Reform (Form of Warrants) Regulations 2003 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke regulation 3(2) and Schedule 2 of the principal regulations.

Sale of Liquor Amendment Regulations 2012 (SR 2012/244)
Made pursuant to section 229 of the Sale of Liquor Act 1989. In force 1 October 2012. Amend the Sale of Liquor Regulations 1990. The regulations prescribe a new form of search warrant for the purposes of the Sale of Liquor Act 1989. The form is required by provisions of the Search and Surveillance Act 2012, which also come into force on 1 October 2012, that apply to the Sale of Liquor Act 1989.

Unsolicited Electronic Messages Amendment Regulations 2012 (SR 2012/245)
Made pursuant to section 58 of the Unsolicited Electronic Messages Act 2007. In force 1 October 2012. Make amendments to the Unsolicited Electronic Messages Regulations 2007 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke regulation 9 and form 3 in the Schedule of the principal regulations.

Weights and Measures Amendment Regulations 2012 (SR 2012/246)
Made pursuant to section 41 of the Weights and Measures Act 1987. In force 1 October 2012. Make amendments to the Weights and Measures Regulations 1999 that are consequential on the commencement of certain provisions of the Search and Surveillance Act 2012. These regulations revoke regulation 88 and form 3 in Schedule 5 of the principal regulations.

Fisheries (Cost Recovery Levies for Conservation Services) Order 2012 (SR 2012/247)
Made pursuant to section 264 of the Fisheries Act 1996. In force 1 October 2012. Sets levies in respect of the fishing year commencing on 1 October 2012 to recover the costs of conservation services in accordance with the Fisheries (Cost Recovery) Rules 2001. The levies take into account, and are reduced or increased by, the relevant settlement sums provided for under section 265A and Schedule 9A of the Fisheries Act 1996.

Fisheries (Cost Recovery Levies for Fisheries Services) Order 2012 (SR 2012/248)
Made pursuant to section 264 of the Fisheries Act 1996. In force 1 October 2012. Sets levies in respect of the fishing year commencing on 1 October 2012 to recover the costs of fisheries services (but not conservation services) in accordance with the Fisheries (Cost Recovery) Rules 2001. The levies take into account, and are reduced or increased by, the relevant settlement sums provided for under section 265A and Schedule 9A of the Fisheries Act 1996.

Energy Efficiency (Energy Using Products) Amendment Regulations 2012 (SR 2012/249)
Made pursuant to section 36(1) of the Energy Efficiency and Conservation Act 2000. In force 1 October 2012. Amend the Energy Efficiency (Energy Using Products) Regulations 2002.

Public Finance (Tāmaki Redevelopment Company Limited) Order 2012 (SR 2012/250)
Made pursuant to section 3A(1)(a)(iv) and (b) of the Public Finance Act 1989. In force 31 August 2012. Inserts the name Tāmaki Redevelopment Company Limited into Schedule 4 of the Public Finance Act 1989. Adding the Tāmaki Redevelopment Company Limited to Schedule 4 means that, under sections 45M and 45N of the Public Finance Act 1989, certain provisions of the Crown Entities Act 2004 apply to the company as if it were a Crown entity under the Crown Entities Act 2004.

Ombudsmen Act (Schedule 1—Tāmaki Redevelopment Company Limited) Order 2012 (SR 2012/251)
Made pursuant to section 32 of the Ombudsmen Act 1975. In force 31 August 2012. Inserts the name of the Tāmaki Redevelopment Company Limited into Part 2 of Schedule 1 of the Ombudsmen Act 1975. The effect of the order is that, on and after 31 August 2012, both the Ombudsmen Act 1975 and the Official Information Act 1982 will apply to the Tāmaki Redevelopment Company Limited.

Companies (Maximum Priority Amount) Order 2012 (SR 2012/252)
Made pursuant to clause 3(2) of Schedule 7 of the Companies Act 1993. In force 28 September 2012. Sets the adjusted maximum priority amount that applies to certain preferential claims by employee creditors of a company in liquidation. This order increases that amount from $18,700 to $20,340 to reflect the overall percentage increase in average weekly earnings in the private sector over the 3-year period starting on 1 July 2009 and ending on 30 June 2012.

Insolvency (Maximum Priority Amount) Order 2012 (SR 2012/253)
Made pursuant to section 276(2) of the Insolvency Act 2006. In force 28 September 2012. Sets the adjusted maximum priority amount that applies to certain preferential claims by employee creditors of a bankrupt person. This order increases that amount from $18,700 to $20,340 to reflect the overall percentage increase in average weekly earnings in the private sector over the 3-year period starting on 1 July 2009 and ending on 30 June 2012.

Hazardous Substances (Forms and Information) Amendment Regulations 2012 (SR 2012/254)

Made pursuant to section 140(1)(m) of the Hazardous Substances and New Organisms Act 1996. In force 1 October 2012. Amend the Hazardous Substances and New Organisms (New Organisms Forms and Information Requirements) Regulations 1998. These regulations prescribe a new form of search warrant for the purposes of the Hazardous Substances and New Organisms Act 1996. The form is required by provisions of the Search and Surveillance Act 2012, which also come into force on 1 October 2012, that apply to the Hazardous Substances and New Organisms Act 1996.

Ozone Layer Protection Amendment Regulations 2012 (SR 2012/256)
Made pursuant to Part 3 of the Ozone Layer Protection Act 1996. In force 1 October 2012. Amend the Ozone Layer Protection Regulations 1996 by prescribing a new form for search warrants. The new form is required by provisions of the Search and Surveillance Act 2012, which also come into force on 1 October 2012, that apply to the Ozone Layer Protection Act 1996.

Hauraki Māori Trust Board Order 2012 (SR 2012/257)
Made pursuant to section 55 of the Maori Trust Boards Act 1955. In force 31 August 2012. Provides for a further election to be held for a member of the Hauraki Māori Trust Board to represent the Ngāti Paoa section of the beneficiaries of that Board.
